Graduate Visa

Graduate Visa

The Graduate Visa serves as an avenue for international students who’ve attained an eligible UK degree, allowing them to either secure employment or seek it for a duration of two years. Those with doctorate degrees can enjoy this privilege for three years post their studies.

However, the Graduate Visa isn’t a direct pathway to permanent residency. Still, holders of this visa can transition to other employment-focused routes that could eventually lead to settlement.

Key Criteria for Graduate Visa

To be considered for the Graduate Visa, UK Visas & Immigration demands that:

  1. You have successfully finished a UK degree or another qualifying course.
  2. Your educational institution is a recognised Higher Education Provider with a consistent compliance record.
  3. You’ve had student permission, specifically for your UK qualification, for a certain duration.
  4. At the time of your application, you’re within the UK with valid Student or Tier 4 Student status.
  5. You haven’t been granted permissions via the Doctorate Extension Scheme (DES) or the Graduate route before.
  6. No reasons exist for your application to be refused based on suitability.

Since every applicant’s situation might be different, it’s advisable to consult an immigration expert for clarity.

Courses Qualifying for the Graduate Visa

For the Graduate Visa extension, your UK bachelor’s, postgraduate degree, or a specialised course (at the UK bachelor’s level or above) should be in a profession governed by UK laws or a UK public authority. Moreover, Student Union Sabbatical Officers, post their qualifying courses, can also apply.

Duration Criteria for Student Permission

Your eligibility for the UK Graduate Visa depends on the length of your course and the corresponding time you’ve had student permission.

  • Courses <= 12 months: You should have had Student permission for the course’s entirety.
  • Courses > 12 months: At least 12 months of permission on the Student route is mandatory, during which you studied in the UK.

No Need for Sponsorship with the Graduate Visa

The Graduate Visa doesn’t necessitate any job offers or Certificate of Sponsorship, making the application process smoother.

Job Search and Employment Privileges

Graduate Visa holders can freely hunt for jobs and switch between them without any restrictions on role, skill level, or salary.

Your Rights with a Graduate Visa

Successful Graduate Visa recipients can remain in the UK for two years after bachelor’s or master’s completion, while doctorate holders get three years. However, extensions on this route aren’t possible. Though the Graduate Visa doesn’t provide direct settlement, transitioning to other routes like Skilled Worker, Global Talent, or Innovator Founder can lead to it, provided the criteria are met.

Your Dependents and the Graduate Visa

Current dependents in the UK can extend their stay when you apply. However, only children born during your Student or Graduate tenure are considered new dependents.

COVID-19 Implications

Post-COVID, certain allowances were made for international students. Distance learning from 24 January 2020 to 6 April 2022, resulting from the pandemic, doesn’t hinder the requisite UK study duration, given specific conditions.

Considerations for Graduates with Expired Tier 4 or Student Permissions

Those who graduated before 1 July 2021 with expired Tier 4 (General) Student or Student permissions aren’t eligible for a Graduate Visa. Still, alternatives like Skilled Worker, Innovator Founder, or Global Talent may be accessible.
