The Family Member of a PBS Migrant visa class in the UK caters to partners and offspring of individuals on the points-based system, allowing them to reside in the UK with their relative. To be eligible for this visa, one should be related to a PBS migrant, being their spouse, civil partner, unmarried or same-sex partner, or a child who was under 18 years of age when the initial application was made.
Eligibility for Family Member of a PBS Migrant Visa
For a successful application as a partner of a PBS migrant, UK Visas and Immigration demands the following:
- Age above 18 years.
- Be the spouse, civil partner, unmarried, or same-sex partner of an individual who currently holds or is simultaneously obtaining a PBS migrant visa. If renewing, your partner should either have Indefinite Leave to Remain (ILR) with a PBS migrant history or have gained British citizenship post receiving ILR as a PBS migrant.
- For unmarried or same-sex partners, proof of a 2-year-long relationship akin to marriage or civil partnership is mandatory.
- An ongoing relationship with the PBS migrant with plans to cohabit for the entirety of their stay in the UK.
- No intentions of staying beyond the PBS migrant’s granted leave.
- Meet the maintenance funds requirement, unless associated with a Tier 1 Investor migrant.
- If you’re applying for an extension, your last UK entry shouldn’t have been as a visitor, short-term student, or under temporary admission/release.
- For partners of Tier 1 Investors or Entrepreneurs aged above 18, provision of a criminal record certificate is required for any country resided in for 12 months or more over the last 10 years.
For the child of a PBS migrant:
- You must be a child of someone holding or obtaining a PBS migrant visa, or has ILR or British citizenship with previous PBS associations.
- Under 18 during the application, unless last granted leave as a child of a PBS migrant or other category who has since achieved PBS migrant status.
- No existing marriage or civil partnership, independent family units or independent life.
- No intention of exceeding the PBS migrant’s granted stay.
- Both parents should be lawfully in the UK or simultaneously obtaining permission. Exceptions exist if the PBS migrant is the sole guardian, has full responsibility for upbringing, or if there are compelling reasons for the application with proper care arrangements in the UK.
- Must meet the maintenance funds requirement unless associated with a Tier 1 Investor migrant.
These guidelines may differ based on individual circumstances. Thus, consulting an immigration solicitor might be beneficial.

Successful applicants typically receive a permit aligned with the PBS migrant’s visa expiry. If the PBS migrant has ILR, a three-year visa is typically granted. Post this period, further application can be made towards obtaining ILR.
If a primary migrant switches job roles or educational establishments, PBS dependents can stay till their current PBS dependent visa expiration.
From 11 January 2018, partners of PBS migrants must meet a 180-day residence prerequisite for indefinite leave to remain. The Home Office assesses UK departures on an ongoing basis.
Children over 18, who haven’t previously obtained a family member of a PBS migrant visa, or other relatives like parents or grandparents, are not eligible under this category.
